The Verkhovna Rada has toughened responsibility for overloaded vehicles


The Verkhovna Rada of Ukraine on June 3, 2021, adopted the Law "On Amendments to Certain Legislative Acts of Ukraine Concerning Certain Issues of Implementation of Dimensional and Weight Control", the press service of the parliament reports. The law increased the responsibility of road carriers for exceeding the size and weight standards established by law. Now, data from Weigh-in-Motion sites (WIM-complexes), which are installed on the repaired roads, will become the basis for imposing fines on carriers who violate weight control.
The law provides for the possibility of fixing violations related to the lack of documents (permits) to agree on the conditions and modes of transportation in case of exceeding weight or dimensional restrictions or a document on payment of fares for heavy (large) vehicles in automatic mode. Also, the powers of the central executive body have been established, which ensures the implementation of state policy on safety inland transport, on the collection in a court of payment for travel on roads of vehicles and other self-propelled vehicles and mechanisms, the weight or dimensions of which exceed the normative ones, when carrying out the overall dimensions. - weight control. Exceeding the size and weight standards established by law by more than 30 percent when transporting an indivisible cargo without an appropriate permit or fissile cargo provides for a fine in the amount of three thousand non-taxable minimum incomes of citizens.
The law establishes those road carriers, their authorized persons (drivers), self-employed road carriers, enterprises providing bus station services have the right to record the process of conducting a planned, unscheduled, or raid check (check on the road) through photo and video equipment, without interfering with the conduct of such checks.
The procedure for conducting raid checks (checks on the road) and the procedure for carrying out dimensional and weight control are determined by the Cabinet of Ministers of Ukraine.
The central executive body that ensures the implementation of state policy on safety inland transport, to fulfill the tasks and functions assigned to it, has the right to receive information from state electronic information resources, including from the register of consignment notes.
The law establishes administrative responsibility for offenses in the field of safety in road transport, recorded with the help of photography and filming, video recordings, including those recorded in automatic mode.
Corresponding changes have been made to the laws of Ukraine "On Automobile Transport", "On the Basic Principles of State Supervision (Control) in the Sphere of Economic Activity" and "On Court Fees".
